Budget 2026: Proposed 30% Minimum Tax on Family Trusts
The 2026 Federal Budget has proposed a major change for discretionary (family) trusts.

From 1 July 2028, trustees of discretionary trusts may be required to pay a minimum 30% tax on trust income — even if distributions are made to lower-income beneficiaries.

What’s important to know:
✔ This is currently a proposal, not law
✔ Individual beneficiaries would receive tax credits for tax already paid
✔ Some trusts and income types are excluded
✔ A proposed restructuring rollover relief period may run from 2027–2030

Most importantly:
🚨 Don’t rush into restructuring based on a Budget announcement alone.

The legislation has not yet been drafted, and the rules may change significantly before becoming law.
